Participate in the Jacuzzi® Relaxation Kit Giveaway

Subject to the following Terms and Conditions, Jacuzzi Brands LLC, through some of its U.S. subsidiaries (“Jacuzzi”) will be conducting a random drawing and giving Prizes (defined below) to people who comment on and tag a friend on a designated daily Facebook post of Jacuzzi promoting the giveaway during the Giveaway Promotion Dates. The drawings and giveaways are subject to the following terms and conditions.

OFFICIAL TERMS AND CONDITIONS (“Rules”)

Giveaway Promotion Dates: June 21, 2021 through June 28, 2021

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF RECEIVING A PRIZE.

READ CAREFULLY: This Giveaway will run in accordance with these Rules. The Sponsor (as defined below) reserves the right, subject to any required approval of any regulatory authorities, to cancel, amend, modify or terminate the Giveaway or these Rules at any time in its sole discretion and without further notice. Changes to these Rules will be posted on Jacuzzi’s Facebook page. You must comply with these Rules and you will be deemed to have received, understood and agreed to these Rules, if you participate in the Giveaway. Open to legal residents of the United States who are the age of majority in their state/province of residence at time of Entry. Void wherever prohibited by law. Employees of Jacuzzi Brands LLC and its parents and its and their respective affiliates, subsidiaries, advertising and promotion agencies and suppliers, and employees or family members of authorized Jacuzzi® dealers and the immediate family members (i.e. spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren) and/or those living in the same household of each are not eligible. By participating, participants agree to be bound by the Rules and the decisions of the Sponsor.

TO ENTER GIVEAWAY: Subject to the eligibility restrictions on residency, age of majority and other conditions and the Prize Restrictions herein, the Giveaway is open to all participants who comment on a designated Facebook post of Jacuzzi that references the Giveaway (“Entry”).  Entries are limited to one per person per day of the Giveaway, posted during Pacific Time hours during the Giveaway Promotion Dates.

PRIZE: Subject to the restrictions below, winner(s) will receive a predetermined gift package, which includes one (1) Jacuzzi® robe, one (1) rubber duck, and one (1) gold medal (each set of three a “Prize”). The Prize values approximately $50. Winner includes person who commented and the person they have tagged in the same post. Each winner and the person they tagged will receive their own prize package for that drawing. Two winners will be pulled from valid entries received during the Giveaway Promotion Dates, for a total of 4 prize packages total.

RANDOM DRAWING AND CLAIMING OF PRIZE: Jacuzzi will randomly select the winner(s) on the Wednesday following that Giveaway Promotion Dates. Decisions of Sponsor are final on all matters. Jacuzzi will post the winners Facebook profile names on Facebook, and send an Instant Message to each winner’s Facebook account, requesting information on where to send the Prize. Winners shall have seven (7) days from Jacuzzi sending the Instant Message to respond. Failure to respond within seven (7) days will be deemed by Sponsor as a rejection and forfeiture of acceptance of Prize, and another random draw from all remaining eligible Entries will take place, with the same notification procedure and time to respond applicable. Odds of winning will depend upon the number of eligible Entries received. If you are determined by the Sponsor, in the Sponsor’s sole discretion, to have failed to comply with these Rules, you will be disqualified from the Sweepstakes, and all related Entries shall be deemed null and void.

PRIZE RESTRICTIONS: Limit one (1) Prize per household address per day. Total Giveaway not to exceed 4 Prizes. No mechanically reproduced entries of any kind permitted. Illegible and incomplete entries are void. Sponsor will make no offer of any guarantee, either express or implied, in connection with this Giveaway. Prize details and availability are subject to change, in which case a Prize of equal value may be substituted at Sponsor’s sole discretion. The Prize(s) consist of only those items specifically listed as part of the Prize. No substitution or transfer/assignment of Prize by participants/recipients permitted. All federal, state and local taxes are the sole responsibility of the participant/recipient. All federal, state and local laws and regulations apply. Return of any Giveaway notification as undeliverable, failure of participant to respond, and/or failure to comply with all Rules will result in disqualification. The participant/recipient may be required to submit a picture and other form of proper identification (including the qualifying residence address) to claim any Prize. Sponsor reserves the right to substitute any Prize with a Prize of equal or greater value.

PERSONAL INFORMATION: The Sponsor is collecting personal information about you for the purpose of administering the Giveaway. Your personal information will be used for the administration of the Giveaway, including contacting selected participants/recipients, the awarding of the Prizes and in aggregate, non-personal form in orders to create reports regarding participant/recipient demographics and consumer habits, which reports the Sponsor may disclose to others. By entering the Giveaway, you consent to the collection, use, storage, sharing and disclosure by the Sponsor (and its officers, directors, employees, agents or representatives) of the personal information provided by you in the Giveaway Entries in accordance with the Sponsor’s privacy policy (available at https://www.jacuzzi.com/en-us/privacy-policy.html).

Acceptance of any Prize constitutes permission to the Sponsor to use participant’s/recipient’s name, voice, statements, image and likeness for purposes of advertising and trade, in any medium, without further compensation or notice, unless prohibited by law. Submission of contact information in connection with this Giveaway (whether or not required), including mailing address, phone number, and email address during Entry constitutes permission for Sponsor to add participant to Sponsor’s customer database and to contact participant in the future for promotional reasons. You may opt-out of receiving such communications as provided within any such marketing materials (e.g., using the “Unsubscribe” feature provided in the footer of Sponsor’s emails).

ADDITIONAL TERMS: By participating, participants agree (a) to these Rules and decisions of judges which shall be final in all respects; (b) to release and hold harmless Sponsors, their respective subsidiaries, affiliates and agencies, and their respective directors, officers, employees, agents and representatives from any and all claims, demands, costs, expenses, liability, losses or damages of any kind resulting from their participation in the Giveaway or their acceptance, use or misuse of a Prize, including liability for personal injury or death; (c) if a participant/recipient, to the use of name and/or photograph for advertising and publicity purposes, without compensation (unless prohibited by law) and to execute specific consent to such use if asked to do so, and to the announcement of their name, city and state; and (d) that Sponsors and their respective agents have not made any representation, warranty or guaranty, in whole or in part, in law or in fact, relative to the Prize. Return of any Prize/Prize notification as undeliverable may result in disqualification of participant/recipient. Failure of winning participant/recipient to respond to Jacuzzi’s Instant Message within seven (7) days of the Instant Message having been sent will result in disqualification of the participant/recipient. Jacuzzi is not responsible for any disruption or other problems of service associated with the internet or Facebook, that delays participant/recipient receiving or responding to Jacuzzi’s Instant Message, Jacuzzi’s timely receiving a response to its Instant Message, or any other problems in claiming a Prize associated with any equipment, computer, cell phone or other device. If participant/recipient is not of the age of eighteen (18) years of age or older at time of Entry, participant/recipient will be disqualified. Sponsors, their respective officers, directors, affiliates, subsidiaries, agents and representatives and their respective employees are not responsible and shall not be liable for: (a) any telephone, electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction, injury or damage to participant's or any other person's computer relating to or resulting from participation in this Giveaway or by any human error which may occur in the processing of Entries; (b) failed, incomplete, garbled or delayed computer transmissions; (c) late, lost, illegible, postage-due, incomplete, damaged, stolen, tampered or misdirected Entries or mail; printing or human errors and (d) any condition caused by events that may cause the Giveaway to be disrupted or corrupted (e) failure of participant to get the confirmation email referenced above. Proof of mailing is not considered proof of delivery or receipt. All Entries become the property of Sponsor and will not be returned or acknowledged. Sponsors reserve the right in their sole discretion to cancel or suspend the Giveaway or any portion thereof should any causes corrupt the administration, security or proper play of the Giveaway; in which case, Prize will be awarded via selection by Jacuzzi from among all eligible Entries legitimately received prior to cancellation. In case of dispute, Entries will be declared made by the authorized account holder of the email address or home address used to participate at the time of Entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning email address for the domain associated with the submitted email address.

CAUTION: ANY ATTEMPT BY AN PARTICIPANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

In no event will Sponsors, their respective subsidiaries, affiliates and agencies, and their respective directors, officers, employees, agents and representatives be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of your access to and use of the internet site www.jacuzzi.com, Facebook or other sites promoting the Giveaway or the downloading from and/or printing material downloaded from said sites. Without limiting the foregoing, everything on this site is provided "as is" without warranty of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement. Entries become the property of Sponsors. No Prize transfer. No Prize substitution except at Sponsors' sole discretion. Void where prohibited by law.

RELEASE AND INDEMNITY: BY ENTERING THE GIVEAWAY, YOU HEREBY RELEASE AND HOLD HARMLESS EACH OF THE RELEASED PARTIES FROM ANY LIABILITY, CLAIM OR DAMAGE (INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, BODILY INJURY, DISABILITY, DEATH, PROPERTY DAMAGE AND LOSS OR DAMAGE OF ANY OTHER KIND) ARISING DIRECTLY OR INDIRECTLY, IN WHOLE OR IN PART, FROM OR IN CONNECTION WITH THIS GIVEAWAY OR PARTICIPATION IN ANY GIVEAWAY-RELATED ACTIVITIES, OR ANY USE, COLLECTION, STORAGE AND DISCLOSURE OF PERSONAL INFORMATION OR, IF DECLARED A RECIPIENT, ANY PRIZES (INCLUDING ANY USE OR MISUSE OF ANY PRIZES).

YOU WILL HOLD ALL OF THE RELEASED parties HARMLESS IN THE EVENT IT IS DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THE RULES.

THIS RELEASE AND INDEMNITY SHALL CONTINUE IN FORCE FOLLOWING THE TERMINATION OF THE GIVEAWAY AND/OR THE AWARDING OF ANY PRIZE.
