Jacuzzi Brands LLC dba Jacuzzi Group and/or its affiliates (“Jacuzzi,” “we,” or “us”) are committed to protecting your privacy and security. We want you to understand how we collect and use information from our websites, SmartTub® mobile application (collectively, the “Sites”), and other platforms (collectively, and together with the Sites, the “Services”) that link to this Privacy Policy. We respect your right to privacy when you use our Services, communicate with us electronically, and otherwise provide us with your Personal Information. We have developed this Privacy Policy to inform you of how we handle the Personal Information you provide us.

By using the Services, you consent to the collection and use of your Personal Information in accordance with this Privacy Policy and you agree to the Terms of Use linked at the bottom of any of the Sites. If you are a dealer, retailer, show room, or service provider (each, together with its affiliates, a “Dealer”), you further agree to the Dealer Connect Terms of Use linked in the Dealer Connect portal.

For Residents of Countries Outside the United States (US): We are a US company and if you are located outside the US, you understand and agree that your information will be processed in the US in accordance with US data protection laws. If you are located in a jurisdiction outside of the US, please review Section VIII. Privacy Rights in Jurisdictions Outside of the US. For purposes of European data protection law, including the General Data Protection Regulation (GDPR), Jacuzzi processes Personal Information as a controller or joint controller, depending on our relationship with you.

  1. Information We Collect

“Personal Information” refers to any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual.

We may collect Personal Information directly from individuals who use or access our Services, visit one of our Dealers or their websites, work for our Dealers, attend our conferences, trade shows, and other events,  or otherwise contact or interact with us. We may also collect information indirectly via tracking technologies on our Sites, or from other sources such as advertising and market research partners or social media. Jacuzzi uses a third-party service provider to collect and process payment card information. As such, Jacuzzi does not collect or store any payment card information. The Personal Information we may collect includes the following:

  • Contact information such as name, email address, phone number, or mailing address;
  • Business contact information such as name, business email address, business mailing address, and business phone number if you work for one of our Dealers;
  • Account details such as username and password;
  • Order information such as billing and shipping address, phone number, and transaction information (e.g., billing details).
  • Website tracking data such as IP address and device information;
  • Inferences drawn from any of the information listed above to create a profile about an individual reflecting their preferences, characteristics, behavior, or attitudes.

We may also collect information automatically on our Sites, which may include Personal Information. Information automatically collected may include IP address, user settings, MAC address, cookie identifiers, mobile advertising and other unique identifiers, details about your browser, operating system or device, location information (including the location of your Jacuzzi product if it is connected to a mobile application, or, with your consent where required by law, precise location to help you find the closest dealer to your location, and inferred location based on your IP address), Internet service provider, mobile carrier, pages you have visited, during and after using the Services, information about the links you click, information about how you interact with the Services, including the frequency and duration of your activities, items or keywords you search for, details about your search criteria, the products that you browse, and other information about how you use the Services.

  1. Online Tracking Technologies

We use cookies and similar technologies such as tracking pixels and web beacons (collectively referred to as “cookies”) to collect user activity information, including your browsing activities and preferences. We may use the following types of cookies:

  • Performance Cookies. These cookies allow us to count visits and traffic sources so we can measure and improve the performance of our site. They help us to know which pages are the most and least popular and see how visitors move around the site. All information these cookies collect is aggregated and therefore anonymous. If you do not allow these cookies we will not know when you have visited our site and will not be able to monitor its performance.
  • Strictly Necessary Cookies. These cookies are necessary for the website to function and cannot be switched off in our systems. They are usually only set in response to actions made by you which amount to a request for services, such as setting your privacy preferences, logging in or filling in forms. You can set your browser to block or alert you about these cookies, but some parts of the site will not then work. These cookies do not store any Personal Information.
  • Functional Cookies. These cookies enable the website to provide enhanced functionality and personalization. They may be set by us or by third party providers whose services we have added to our pages. If you do not allow these cookies then some or all these services may not function properly.
  • Targeting Cookies. These cookies may be set through our site by our advertising partners. They may be used by those companies to build a profile of your interests and show you relevant adverts on other sites. They do not store directly personal information but are based on uniquely identifying your browser and internet device. If you do not allow these cookies, you will experience less targeted advertising.

Our Sites’ cookie management tool is configured to honor opt-out preference signals sent by Global Privacy Control (“GPC”) within your browser. Please note that due to technical limitations, the GPC signal may only be recognized within your current browser. For more information on GPC please visit https://globalprivacycontrol.org.

Some internet browsers have “Do Not Track” or “DNT” features which, when turned on, send a signal to a website that the individual visiting the website does not wish to be tracked. Such browser features and industry standards are not uniform, so our Sites do not respond to DNT signals, but you can control your cookie preferences in the settings of your Internet browser. Please note that if you block or reject cookies on our Sites, some functionality of the Sites may be limited.

  1. Information Use

We process Personal Information for a variety of purposes, including to:

  • Provide our products, services, or other information requested;
  • Administrate your user account and profile;
  • Manage orders and purchases;
  • Verify your age to make a purchase;
  • Provide personalized information, offers, and recommendations;
  • Market, advertise, and provide other information about our products and services;
  • Communicate with you;
  • Carry out market research, including evaluation of our customer database to assess which customers would be suitable participants;
  • Coordinate and administer participation in events, competitions, and other similar activities;
  • Develop, improve, and protect our Services, our products, and our business;
  • Secure our Services, carry out audits, detect security or fraud incidents, prevent malicious, deceptive, fraudulent or illegal activity, enforcing our agreements and legal rights;
  • Produce anonymous, aggregated datasets, and to conduct analytics on these datasets to better understand our customers, set our business and marketing strategies and provide relevant data to our partners for their business use;
  • Comply with laws, regulations, legal processes, and internal policies; and
  • Exercise and defend legal claims.
  1. Grounds for Processing

For those processing activities that fall under the GDPR, the legal basis for processing Personal Information that Jacuzzi relies on may vary depending on the jurisdiction, the types of Personal Information being processed, the nature of the processing being undertaken, and the manner and context in which you engage with us.

In some cases, we may ask for consent for the collection and use of Personal Information through our Sites and for Personal Information processed for marketing and educational purposes. In other cases, we may process Personal Information based on our legitimate business interests. In specific circumstances, we may need to process Personal Information to comply with a legal obligation to which we are subject, or if necessary to perform or enter into a contract. We also reserve the right to process Personal Information in the event we believe doing so is necessary to protect the rights of the individual or another person.

  1. Information Disclosure

We disclose Personal Information in the following ways:

  • To affiliates and subsidiaries within our corporate family;
  • To our dealers when you ask us to share your information with them;
  • To third-party marketing, advertising, analytics, and social media companies, who may process Personal Information for their own purposes;
  • In connection with the sale, assignment, or other transfer of the business of the Sites to which the information relates, in which case we will require any such buyer to agree to treat it in accordance with this Privacy Policy and use it only for the same purposes;
  • To respond to law enforcement requests or where required by applicable laws, court orders, or government regulations;
  • To third parties as deemed necessary to comply with legal requirements or to establish or exercise our legal rights to defend against legal claims; or
  • When we believe it is necessary to share information to assist in an investigation regarding, or to prevent, illegal activities, suspected fraud, or potential threats to the safety of any person.

Jacuzzi does not sell Personal Information for monetary consideration, though certain of our digital analytics and advertising activities may constitute a “sale” or “sharing” of Personal Information as those terms are defined under applicable privacy laws (see further discussion in Your Privacy Rights and Privacy Notice for California Residents sections below).

Jacuzzi does not collect, use, or sell Personal Information for the purpose of training large language models.

  1. Your Communication Choices

You may opt out of receiving email marketing communications from us by clicking the unsubscribe link included in our emails or by contacting us. Please note that we may still send you transactional and administrative emails even if you opt out of marketing communications.

You may opt-out of receiving automated text message marketing communications from us by replying “STOP” to the message or contacting us. Please note that we may still send you transactional and administrative text messages even if you opt out of marketing communications.

Based on where you live, you may have additional rights regarding your Personal Information (see further information in the Your Privacy Rights and EEA Privacy Rights sections below).

  1. Your Privacy Rights

Depending on your state or country of residency, you may have certain privacy rights, subject to certain exceptions, as follows:

  • Right to Access. You may have the right to request that we disclose what Personal Information we collect, use, disclose, and sell about you.
  • Right to Correction. You may have the right to request correction of Personal Information that we maintain about you if you find that the Personal Information is inaccurate.
  • Right to Deletion. You may have the right to request that we delete Personal Information that we have collected from you.
  • Data Portability. You may have the right to request a copy of your Personal Information in a portable and, to the extent technically feasible, readily usable format.
  • Right to Withdraw Consent. You may have the right to withdraw your consent to the processing of your Personal Information.
  • Right to Limit Use and Disclosure of Sensitive Personal Information. You may have the right to limit the processing of your sensitive Personal Information.
  • Right to Opt-Out. You may have the right to opt-out of certain uses of your Personal Information such as for (i) targeted advertising, (ii) “sale” or “sharing” for cross-context behavioral advertising, or (iii) profiling or automated decision-making activities that result in a legal or similarly significant effect on you. We do not engage in (iii), but you can opt-out of uses (i) and (ii) by adjusting your cookies settings to reject analytics and advertising cookies, noting that these adjustments may be specific to the Jacuzzi Sites on which you make them. Additionally, if you visit our Sites with the Global Privacy Control opt-out preference signal enabled, if required by law, that signal will be treated as a request to opt-out of “sale,” “sharing,” or targeted advertising.   • Right to a List of Third Parties. You may have the right to obtain a list of third parties to which we have disclosed Personal Information.
  • Right to Appeal. In some circumstances, we may deny your request to exercise one of your privacy rights described in this Privacy Policy (e.g., if we cannot verify your identity). In such a case, we will communicate this in writing and explain the reasons for the denial. You may appeal our decision by responding to our denial email or submitting a request to privacy@jacuzzi.com. We will notify you of our decision regarding your appeal in writing via an email from privacy@jacuzzi.com within45 days of receipt. If we deny your appeal, you may have the right to contact your state Attorney General to file a complaint.

We do not engage in profiling activities that further automated decisions producing legal or similarly significant effects; however, to the extent your Personal Information is ever used in that way, you additionally may have the right to opt-out of profiling activity that furthers an automated decision producing legal or similarly significant effects, and the right to information on profiling if any profiling is done for the purposes of an automated decision that produces legal or similarly significant effect, including to question the results of profiling, to be informed of the reason profiling resulted in a particular decision, to review your personal data that was processed for the purposes of profiling, to correct incorrect personal data processed for profiling and to have the profiling decision reevaluated accordingly.

  1. Privacy Rights in Jurisdictions Outside of the US

Depending on the country where you reside, you may have privacy rights regarding your Personal Information, including the right to request access to it, receive a copy, and ask that it be corrected. In some jurisdictions, you may also have the right to request erasure, data portability, to object to or restrict certain processing, to be informed about certain automated decision-making, or to request cessation of dissemination or de-indexation of your Personal Information.

Where required by applicable law, we obtain your consent before or at the time that we collect, use, or disclose your Personal Information. The form of consent may be express or implied, depending on the sensitivity of the information and the reasonable expectations of the individual. Where our processing is based on your consent, you may withdraw that consent at any time, subject to applicable legal or contractual limits, and we will stop the relevant processing going forward. Withdrawal does not affect the lawfulness of processing based on consent before its withdrawal. To withdraw your consent, please contact us using the information provided in the How to Contact Us section below. To respond to your request, we may ask for information necessary to verify your identity, which will be used only for that purpose. In some cases, if you withdraw your consent, we may not be able to provide certain Services to you. We may also collect, use, or disclose your Personal Information without your consent where permitted or required by applicable law.

You may also have the right to make a complaint to the applicable privacy or data protection regulator. If you are a resident of Australia, you may complain about a breach of the Australian Privacy Principles using the contact details in the How to Contact Us section below.

To the extent that any Personal Information is transferred from your country of residence to another country, including the US, and where required by law, we implement appropriate data transfer mechanisms, including the EU Standard Contractual Clauses to affect the lawful transfer of your Personal Information.

  1. Exercising your Privacy Rights

Requests to exercise these rights may be made using the contact information listed at the end of this Privacy Policy. Only you or, as permitted by law, a person that you authorize to act on your behalf, may make a request related to your Personal Information. For certain requests, we must verify your request before we can fulfill it. Verifying your request will require you to provide sufficient information for us to reasonably confirm that you are the person about whom we collected Personal Information or that the requestor is authorized to act on your behalf. We will not discriminate against you for exercising your privacy rights.

  1. Information About Children

The Services are not intended for children under the age of 18. We do not knowingly collect Personal Information via the Services from visitors in this age group.  If you believe that we have unintentionally collected Personal Information about your child, you can contact us by mail or email as described below.

  1. Security

Jacuzzi takes reasonable steps to protect personally identifiable information as you transmit it to our Sites and to protect such information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. You should know and consider that no Internet or mobile device transmission, including text messages, is ever completely secure or error-free. As a result, while we strive to protect your Personal Information, we cannot guarantee that it will be 100% secure. Your transmission of your information to our Sites thus is done entirely at your own risk.

  1. Retention of Personal Information

We retain the Personal Information we collect for the time period required to fulfill the legitimate business purposes for which it was collected and to engage in the use and disclosure practices outlined in this Privacy Policy, unless a different retention period is required by applicable law, or otherwise to fulfill a legal obligation or protect our legal rights. We may also maintain for an indefinite period of time certain Personal Information that has been de-identified. This information is no longer considered Personal Information and we commit not to attempt to reidentify such information.

PRIVACY NOTICE FOR CALIFORNIA RESIDENTS

This Privacy Notice for California Residents supplements the information contained in the Jacuzzi Privacy Policy above (“Privacy Policy”), and applies only to California residents (“You,” “your” or “consumer”). This section provides additional disclosures for residents of California, as required by the California Consumer Privacy Act, as amended (the “CCPA”). Please remember that the information we collect varies based on our relationship with you and note that certain Personal Information or activities may not be reflected in this section because they are exempt from the CCPA.

  1. CCPA Categories of Personal Information We Collect, How and Why We Collect Them

We collect the following categories of Personal Information about California consumers. This information may be, or may have been, collected directly from you, automatically when you use our Services, from third parties, or from publicly available sources.

  • Identifiers, including real name, alias, postal address, unique personal identifier, online identifier, IP address, email address, account name, Social Security number, or other similar identifiers.

  • Internet or other electronic network activity information, including Internet or other similar activity, browsing history, search history, information about a consumer’s interaction with our Sites.
  • Geolocation data, including location data inferred from your device IP address.
  • Audio, electronic, visual, thermal, olfactory, or similar information, including audio recordings of customer calls and webinars.
  • Professional or employment-related information, including business contact information.
  • Non-public education information, including transcripts or other information which may be collected during the hiring process.
  • Inferences used to create a profile reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.
  • Sensitive Personal Information, including information collected and analyzed concerning a consumer’s health; account log-credentials; and precise geolocation. To the extent we collect sensitive personal information, we may use it (namely, information concerning a consumer’s health) for purposes of inferring characteristics about a consumer.

We use the Personal Information we collect for the purposes described in the Information Use section of our Privacy Policy.

We disclose all of the above categories of Personal Information to service providers or to other third parties as described in the Information Disclosure section above.

Per these definitions, we may sell and/or share the following categories of Personal Information to third party analytics and advertising partners:

You have the right to direct us to not share, disclose, or sell your Personal Information. To exercise this right, you or your authorized representative may submit a request by clicking on the Do Not Sell or Share My Personal Information link on the homepage of our Sites.

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Sites that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes.
